
Terms and Conditions
The “One Container One Story” Drawing Competition ("the Competition") under the Project “Art Container” (“the Project”) is organised by the Hong Kong Maritime and Port Development Board in partnership with the Hong Kong Maritime Museum (collectively as “organisers”). All participants should carefully read and fully understand the following Terms and Conditions prior to enrolling in the Competition.
Participating Requirements

Each participant shall comply with the rules set out in the Competition Introduction, namely, "Rules", "Theme", "Submission Requirements", "How to Enter” and "Submission Deadline", failing which the entry will be disqualified / not be entertained.
Entry

Each participant must enter only one of the following categories: Primary School, Secondary School or Open, and can only submit one entry within that category. Multiple submissions within the same category will not be entertained. Late submissions and incomplete or inaccurate online applications will not be accepted.

Participants are free to create on any theme, yet the Organisers have the right to disqualify any entries which are obscene, vulgar, sexually explicit, lewd, derogatory or offensive.

The design concept statement and the entry must be the participant’s original and sole work without infringing any intellectual property rights and / or other rights of any person or entity. Assistance from third parties is not allowed.

The entry must not have been published or presented or broadcasted publicly in any public events, exhibitions or on any online media platform, and the entry must not have been involved in any commercial activities or submitted in any other competitions or exhibitions or awarded with any prize in Hong Kong or elsewhere before.

Each participant should provide a valid email address. A confirmation email will be automatically sent to the email address provided upon successful submission of the entry. Participants are advised to check the junk or spam folder in case the confirmation email does not appear in the primary inbox. Participants are also advised to follow HKMM’s Facebook (https://www.facebook.com/HKMaritimeMuseum) and Instagram (https://www.instagram.com/ hongkongmaritimemuseum/) for updates on the Competition.

Whenever disputes arise or in the event where the entry may violate any laws (including but not limited to infringement of intellectual property), the Organisers have the sole and absolute discretion to disqualify or disallow such entry, and the decision shall be final and conclusive.
Awards and Prizes

Decisions reached by the Panel shall be final and non-appealable. However, the Organisers reserve the right to forfeit the award(s) from the winner(s) and transfer the award(s) to such other participant(s) as the Organisers deem fit if the winner(s) is / are disqualified for any reason at the discretion of the Organisers, including breach of and / or non-compliance with the Terms and Conditions.

The Organisers have absolute discretion as to the total number of awards and prizes to be awarded in this Competition. The prizes will be subject to any changes thereto as the Organisers see appropriate.

Winners of the awards will be notified separately via phone and email within 4 weeks after the result announcement. Failure of any winner to respond to the notice within 4 weeks after the notification will lead to forfeiture of the award, which may then be awarded to another appropriate participant.
Property Rights / Intellectual Property Right

All participants agree that by participating in this the Organisers have the right to display the entry content, title, synopsis and participants’ information in any form of media for demonstration, publication, exhibition, promotion or any non-commercial activities. The Organisers also have the authority to edit, translate, adapt, use, copy and distribute, in whole or in part of the entries without any need to obtaining any prior consent of or payment of fees to the participants. No part of the entry will be returned to the participant. The Organisers reserve the right and absolute discretion to deal with and dispose of the entry at any time, including whether to return the entry to the participant upon special request and subject to any conditions that may be imposed, provided that if the Organisers shall in its absolute discretion decide to return the entry to any participant as aforesaid, the participant shall accept the return of the entry on an "as is" basis and any conditions that may be imposed. Under no circumstances shall the Organisers take or assume any responsibility for any damage caused to the entry or any change in their condition.

In the event the entry of the participant is awarded any award / prize under this Competition, such participant further agrees, in consideration of such award / prize, to assign to the Organisers exclusively all intellectual property rights of the entry and agrees that such entry shall upon the award of such award / prize become the sole property of the Organisers. Winners of the awards undertake to seek the Organisers’ prior written consent before submitting their entries to any other art competition or exhibition or other activity. If the Organisers have consented to the winner’s submission of the entry in another art competition, exhibition or activity, the winner should inform the Organisers of such competition, exhibition or activity that the intellectual property rights of the entry belong to the Organisers when he/she submits the entry in such competition, exhibition or activity. Further, the winner shall procure the organisers of that other competition, exhibition or activity to give credit to the Organisers when the images, photos or videos of the entry are being displayed in any promotional materials, publication and online platform by the organisers of such competition, exhibition or activity. The winner also undertakes to give credit to the Organisers when the images, photos or videos of the entry are being displayed at any occasion or social forum (including but not limited to Facebook, Instagram or YouTube).
Personal Data

For the purposes of this Competition and Project, the participants will have to provide the Organisers with personal data. Failure to do so shall result in non-acceptance to this Project and rejection of enrolment to the Competition.

Each participant warrants and represents to the Organisers that all personal data provided for the purposes of this Competition and for the Project (if applicable) are true and accurate.

Each participant confirms that he / she consents to the Organisers’ use of the personal data for the purposes of this Competition and for the Project (if applicable), such use to be in accordance with the Personal Data (Privacy) Ordinance.

The personal data collected for the purposes of this Competition will be kept by the Organisers till the end of the Project, and thereafter will be destroyed.

The Organisers may disclose the personal data submitted by the participants when required by law or court order, or as requested by the government or law enforcement authorities, or in the good faith that such disclosure is necessary or advisable to protect the rights or properties of the Organisers, and its subsidiaries

The Organisers may disclose the personal data collected to third parties for the purpose of this Competition and the Project to the external service providers or website developers or other parties engaged by the Organisers to assist with the development, organisation and administration of the Competition and the Project.
Disclaimer

To the fullest extent permitted by law, the Organisers expressly disclaim all warranties or representations in relation to the awards, including and without limitation to, all implied Terms and Conditions as to merchantability, fitness for a particular purpose and exercise of care and skill.

To the fullest extent permitted by law, the Organisers assume no responsibility for any loss or damage that may be suffered or caused as a result of participating in the Project or using any awards nor any damage that may be caused.

No claims, actions or legal proceedings in connection with the Project or participation in the Project brought by any participant or other interested parties will be entertained by the Organisers.

The Organisers reserve the right to change the details of the Project and cancel the Project at any time without prior notice.

By entering this Project, all participants agree to release, discharge, exempt and hold harmless the Organisers and its partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives from any claims, losses, and damages arising out of their participation in this Project or any Project-related activities and the acceptance and use, misuse, or possession of any prize awarded hereunder.

The Organisers assume no responsibility for any error, omission, interruption, deletion or missing of data, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorized access to the Project entries or entry forms; or alteration of entries or entry forms.
Miscellaneous

Upon submission of the entry form, the participant consents to the Organisers’ use of his / her name and his / her entry and design concept in any publicity and / or any publication at the Organisers’ discretion.

The power to interpret the Terms and Conditions shall be vested in the Organisers.

This Project and the Terms and Conditions shall be governed by the laws of Hong Kong SAR.

The English version shall prevail in the event of any inconsistency of interpretation of the Terms and Conditions. The Chinese version is for reference only.
